Policy guidelines
 
 
 
 
The Library's policies constitute a set of rules or principles used to achieve fair and equitable access to Library materials, facilities, and services. Procedures spell out in detail the steps taken by staff to implement policies; procedures are located elsewhere.

The Library's policies and procedures are subject to federal law and state law, including Minnesota Statutes Chapter 134, as well as County policies and collective bargaining agreements.
Policies are regularly reviewed and approved by the Ramsey County Library Board.
Policies may be appealed to the Library Director; final appeals are sent to the Library Board.
The Library reserves the right to change its policies at any time.
The Library reserves the right to make exceptions to policies when the circumstances warrant.

II.A.1.
Registration
II.A.1.a.
Suburban Ramsey County residents
Any resident of suburban Ramsey County may apply for a free library card at any of the public libraries in the Ramsey County system. [link to library info page] Applicants will be required to show picture ID and proof of current address. Temporary Ramsey County residents such as college students may obtain a Ramsey County Library card by showing a picture ID and proof of current residency.
 
 
II.A.1.b.
Children
Children are encouraged to have their own library cards. Minors under 16 are required to have a parent or legal guardian present in order to obtain or replace a library card. Additionally, they must be accompanied by a parent or legal guardian in order to assign or change their PIN. Children 16 years of age and older may obtain a card without a parent or legal guardian, but must be able to show a picture ID and proof of current address. With proper identification, a parent or legal guardian is authorized to impose specific restrictions on the library records of their minor children.
 
Parental Responsibility Statement
Parents are responsible for their own children's library use. Only the parent or guardian may restrict their children's (and only their children's) access to library materials and services. With proper identification, parents may also impose specific restrictions on the library record of their minor child. The Library staff will attempt to honor those restrictions where technologically feasible.
 
 
II.A.1.c.
Twin Cities Metro Area residents
Through agreements with the Metropolitan Library Service Agency (MELSA), residents of the 7-county Twin City metro area who do not live in suburban Ramsey County may apply for a card from their home libraries at any Ramsey County Library by showing picture ID and proof of current address. Children applying for MELSA cards must have their parents with them to show picture identification and verify their address if they wish to check out materials with their application. Individuals who already have a library card from one of the other metro libraries may register it for use in the Ramsey County system by showing their library card and a picture ID.
 
The Metropolitan Library Service Agency is a cooperative organization of the following public libraries and systems:
     Anoka County Library
     Carver County Library
     Dakota County Library
     Hennepin County Library
     St. Paul Public Library
     Scott County Library
     Washington County Library
     Columbia Heights, South St. Paul, Bayport, and Stillwater are associate members
 
 
II.A.1.d.
Minnesota residents
Other Minnesota residents may register their home library cards for use in the Ramsey County system by showing their library card and a picture ID. Non-MELSA Minnesota residents cannot apply for a library card at a Ramsey County Library, but must apply in their home library systems.
 
 
II.A.1.e.
Non-residents
Individuals who do not qualify for a library card under any of the above may apply for a non-resident card with name and address identification and an annual payment of $45.00. Non-residents have the option of using a guest pass to obtain Internet access. Guest passes may not be used to check out materials.
 
 
II.A.1.f.
Customers with disabilities
Customers who are prevented from normal use of a library or library materials due to a disability may ask for a special status (PD- persons with disabilities). Customers with this status are exempt from library overdue charges, but are required to pay for lost or damaged items. Customers are responsible for identifying themselves as eligible for this status.
 
 
II.A.1.g.
Nursing homes/Homebound volunteers
Official Ramsey County Library volunteers providing service to nursing homes or to homebound individuals will be issued a Volunteer library card upon furnishing a picture id and proof of current address.

Homebound persons themselves may apply for a homebound card by verifying their identification with a picture ID and proof of current address.

Nursing homes may also apply for a Volunteer card; however, an employee must be designated as the individual responsible for the materials checked out and a letter with the Nursing Home letterhead must be on file in the Library offices

Individuals with a homebound status and library volunteers working with nursing homes do not accrue overdue charges.
 
 
II.A.1.h.
Homeless customers
Ramsey County Library will provide temporary library cards for individuals who identify themselves as homeless, or temporarily without a permanent address. These registrations are solely for the purpose of accessing the library's public Internet terminals and may not be used to check out library materials.
 
 
II.A.1.i.
Safe at Home Program
The Library subscribes to the Minnesota Secretary of State "Safe at Home" Address Confidentiality Program. Any adult applying for a library card who is in possession of an official Program Card will be registered using the Program address.
 
 
II.A.1.j.
Companies
Companies in suburban Ramsey County may apply for a library card. A letter on the company's letterhead must be on file in the Library's Administrative Office indicating a person designated as the individual responsible for the materials checked out and for paying overdue or other charges.
 
 
II.A.1.k.
Schools and Day Care Centers
Schools and day care centers in suburban Ramsey County may apply for a library card. However, an employee must be designated as the individual responsible for the materials checked out on the card and a letter on the school or day care letterhead must be on file in the Library's Administrative Office indicating the responsible person's name and the school or day care center's agreement to be responsible for items checked out and any overdue charges.
 
 
II.A.1.l.
School Delivery Program
Schools in suburban Ramsey County participating in their District's School Delivery Program may apply for a library card. An employee must be designated as the contact person. The District is responsible for lost or damaged items, but is not responsible for overdue charges.
 
 
 
 
II.A.2.
Lost or Stolen Library Cards
Customers are responsible for library materials checked out on their cards. Lost or stolen cards should be reported immediately to the Ramsey County Library system as well as any other public libraries where their card is registered. With picture ID and proof of current address a new card will be issued to the customer.

As long as a lost or stolen card has not been reported to our library system, the customer may be financially responsible for any materials checked out, and any charges or fees that are incurred.

Requirements for checkout
A library card is required to check out materials. If the library card is left at home, materials may be checked out if the customer can provide picture identification and proof of current address. A memorized barcode number is not considered identification.

Loan policies
II.B.2.a.
Loan periods
The regular loan period for books, periodicals, CDs, or audio cassettes is three weeks. Some books on the "request" or "best seller" list have a circulation period of two weeks and may not be renewed. Videocassettes and DVDs have a one-week loan period.

Some materials have special circulation periods (see chart below in Fines and Fees section).
 
 
II.B.2.b.
Renewals
Customers may renew most Ramsey County Library materials on their record, provided no other customer has requested them and the item has not been assigned a non-renewable status. Ramsey County Library allows up to two renewals on such items.
 
 
II.B.2.c.
Circulation limits
The Library reserves the right to limit the number of items and the number of certain types of items checked out or requested by any individual at one time.

The decision to impose such restrictions will be made by the Library Director on a case-by-case basis.

Exceptions to standard loan policies

Rental Books and DVDs
Each Library has a collection of rental books and DVDs that may be borrowed by customers and staff.

The rental book and rental DVD collections are not funded by taxpayer dollars. They were originally funded by a gift from the Library's Friends and are now self-sustaining services. Their existence in no way affects the number of copies the library has in its regular collections, and everything that is available as a rental is also available for free.

Overdue charges
Ramsey County Library wishes to encourage customers to return materials promptly in order to provide better services to all library users. Overdue charges help ensure the timely return of materials.

For each type of material there is:
  A daily overdue rate
  A maximum overdue charge
  A replacement fee

Ramsey County charges for overdue materials based on item type. The basic overdue charge of $0.30/day applies to adult materials. The basic overdue charge of $0.10/day applies to easy (E), juvenile (J) and teen (YA) materials. Some collections have other overdue rates. The replacement fee will be the amount the library paid for the item. If that cost is unavailable, a default replacement cost based on the type of item will be assigned.

Customer card types that do not incur overdue charges
The following customer card types do not incur overdue charges* but are held responsible for lost or damaged items:

II.C.4.
Service threshold
When an individual has accumulated more than $10 in overdue charges and fees or when an individual has more than 10 items still out and overdue, borrowing privileges are suspended until charges or items out have been brought under the threshold.
 
 
 
 
II.C.5.
Lost or damaged items
The library system expects customers to return materials in good condition. Customers are responsible for damages that occur to the materials while they have them checked out and are required to pay for such damages.

If an item has been overdue for more than 60 days, or has been in a Claims Returned status for six months, a replacement charge will be applied to the customer's record.

The library system requires customers to return materials with the packaging in which they were checked out. Customers are responsible for replacement of packaging not returned.

II.C.6.
Refunds
Lost items which have been paid for may be returned for a refund with the following exceptions:
If the original due date of the item is more than one year in the past, no refund is possible.
If payment for the lost materials was made through Revenue Recapture tax or rebate deductions, no refund is possible. $5, no refund request will be submitted. Rather, the credit will remain on the customer's record and be used against future charges.
All refunds must be processed through the library's administrative office. No refunds are given from the library's cash drawer. Staff will complete the library's Request for Refund form, including detailed information on the item(s) being refunded, and the borrower's contact information. If the borrower is present, please have him/her sign the refund request form.
Refunds on items paid for and then returned are subject to the standard overdue charge. This amount must be deducted from the amount being refunded, keeping in mind overdue limits.
The appropriate refund amount is added to the borrower's record, by going to Blocks at the menu bar, then Add Fee. Enter the amount of the credit, being sure to have a hyphen before it. In the Comment field, enter the basis for the refund, your initials and branch. (Grapes of Wrath, L/Pd/Ret. jcb/rv)
Add a special message stating that the refund has been applied for.
 
 
 
 
II.C.7.
Contract for Community Service Workers
This contract is to be used at the discretion of the library manager, in special circumstances, where library customers agree to work to reduce or eliminate overdue charges instead of paying for them. Charges will be removed ONLY after all the contracted hours have been fulfilled.
 
 
 
 
II.C.8.
Revenue Recapture
Customers owing $25 or more in fines and fees will be considered for Ramsey County Library's debt collection process. Before a customer's account will be certified for the Revenue Recapture Program, the customer will be sent a Dunning letter to their last known address, requesting that they contact the Library to make payment or arrange a payment plan. If no response is received within 14 calendar days from the date of the Dunning letter, the customer's account will be certified for the Minnesota Revenue Recapture Program, where it will remain until the amount owed has been fully satisfied, or until decertified by the Library. Customers may voluntarily make payments or return lost items less than one year overdue at any time during the debt collection process.

The Ramsey County Library is a customer-oriented system which attempts to anticipate client needs and respond to high-demand requests. The Ramsey County Library in Roseville is the resource center for the system and its collection includes specialized titles, technical information, and in-depth materials of interest to the general public. Materials will be available in all subject areas somewhere in the system, but not necessarily in each location.

The Ramsey County Library is firmly committed to cooperative networks and resource sharing through interlibrary loan.

The Library attempts to provide a broad spectrum of informational, educational, and recreational materials in a variety of formats.

The Library subscribes to the American Library Association's Bill of Rights, and supports ALA's Freedom to Read and Freedom to View Statements.

Materials are selected using basic selection tools and reputable reviewing media. Fiction materials are selected on the basis of creative worth, literary style, interest and demand. Nonfiction materials are selected on the basis of purpose, authoritativeness, accuracy, significance, format, and content.

Through continuous professional selection and weeding of materials, the Library will strive to maintain a balanced collection; however, the quantity of materials purchased in a subject area will depend upon current needs, current material available, and availability of funds.

The Library cannot supply materials (such as textbooks) of interest only to special groups.

Suggestions for the purchase of materials from the public and other members of the library staff are encouraged. The same criteria used in the selection of new materials will be applied.

Usable materials withdrawn from the Library's collections will be made available to the Friends of the Library.

Any Ramsey County Library customer has the right to protest the presence of any materials found in the Library's collections. The protest will be reviewed by a committee of librarians, who will make a recommendation to the Library Director. The Director will make the decision as to the disposition of the protested material. The customer may appeal the Director's decision to the Library Board, which will make the final decision.

The Ramsey County Library is interested in providing attractive educational and cultural exhibits for the public.
Exhibits should not distract from or disrupt library experiences or opportunities.
Exhibits sponsored by the Library will take precedence over other types of exhibits.
The exhibit should be of general interest, suitable for all ages, and consistent with the Library's mission, as determined by the Library.
The Library reserves the right to refuse any exhibits, including but not limited to those that primarily promote commercial interests, as determined by the Library.
The Library reserves the right to refuse, discontinue, and/or remove the exhibit or any individual pieces of the exhibit at any time without notice.

Community Program Rooms

Community program rooms are available at Ramsey County Libraries. These rooms may be used by qualifying groups free of charge, and by for-profit groups for a fee. The Library affirms the American Library Association's policy that "libraries which make meeting rooms available to the public should make such facilities available on an equitable basis, regardless of the beliefs or affiliations of individuals or groups requesting their use."

To keep space available to as many groups as possible, the Library may limit use by groups requesting regularly scheduled (e.g. weekly) meetings or events. If a library's community program room is already used frequently by non-profit groups or organizations, the library manager may decline requests made by for-profit organizations. The community program rooms are not available for private parties.

Exceptions to the guidelines in this policy may be made at the discretion of the Library Manager.

For-profit organizations will be charged a fee for using a library meeting room. The fee is based on room capacity.

IV.B.2.
Public procedures for booking
Community program rooms are only available during hours the library is open.
Reservations will only be accepted up to 60 days prior to the meeting date.
Groups cannot book a community program room more than two times per calendar month.
In-person and telephone reservations are permitted. When the reservation is made by telephone, the Community Program Room Registration form must be completed before the group's meeting begins.
Each group must have a designated contact person registered (name and daytime phone number) with the Library staff. The Community Program Room Registration form must be completed, signed by the contact person, and turned in to library staff prior to using the meeting room. This contact person will be responsible for the condition of the room following the event, and/or liable for all costs should the room need to be cleaned, or for damage to Library property.
For-profit organizations must pay the rental fee prior to the start of the event.
Please include set-up and take-down time when making the reservation. Community program rooms must be vacated by the time specified on the reservation. All meetings must end 15 minutes prior to library closing time to allow time for cleanup.
All community program rooms are supplied with tables and chairs. Setting up and taking down the folding tables, as well as stacking and unstacking the chairs, is the responsibility of the group using the room.
The group is expected to leave the room in the condition established by each branch. Whenever possible, meeting rooms will be inspected by a library staff member after each group is finished. Any damage or other unacceptable condition will be reported immediately to the supervisor, manager, or librarian in charge. FAILURE TO LEAVE THE ROOM IN ACCEPTABLE CONDITION WILL FORFEIT YOUR PRIVILEGE TO USE THE COMMUNITY PROGRAM ROOM IN THE FUTURE.
Events must not disturb other library activities.
Please inform the library if your event is canceled. Failure to do so may forfeit your privilege to use the room in the future.
The library is not responsible for injury or property loss during the use of a community program room.
Library-sponsored programs and Library-related groups are given priority.
When necessary, the library reserves the right to cancel a scheduled use of a community program room.
No office supplies (paper, pencils, flip-chart paper) or services (copying, faxing) will be provided. Audio visual equipment may be provided by the library, if available.
Sales activities are not permitted unless permission is given by library manager.
Rulings of the Fire Marshal regarding capacity, health, and safety issues must be observed.

Free Materials

Each library may make available giveaway copies of certain free newsletters and materials on subjects of educational, cultural, civic, and recreational interest. Where space permits, each library may establish a designated public forum in an area of the library for the distribution of free materials.

Items distributed or posted in the designated public forum will be reviewed by the Library Manager, and will not be regulated by content, except in those situations where the usual First Amendment protections would not be available. However, each library may choose to make individual regulations concerning the manner, time, and place of their posting or distribution.

Each area designated as a public forum must be clearly delineated and must also bear the following notice, prominently displayed:

The Library sponsors programs of informational, educational, and recreational interest.

Programs should emphasize literacy, the Library, and its resources.
Programs should be publicized in advance.
Programs should attract a sizable audience.
Programs should be cost-effective.
Programs should be consistent with the Library's Mission and Strategic Plan.

Public Bulletin Boards

The Ramsey County Library maintains public bulletin boards to inform the public about matters of local or general community interest.

The Library reserves the right to decide what material is to be posted based on the availability of space, the timeliness of the event, and these guidelines.
Persons wishing to have information posted should submit it to the library manager for approval.
All items are to be dated and posted for a period of time not to exceed one month, unless other arrangements are made.
Library and County information to be posted takes priority over other types of materials.
There will be no posting of business advertising, or solicitation by profit-making organizations. No private want ads (for sale, for rent, garage sales, etc.) are to be posted.
The Library ascribes to the principles stated in the "Library Bill of Rights" and the "Freedom to Read Statement" of the American Library Association and those principles serve as general guidelines

The Ramsey County Library seeks to provide an environment that is conducive to the development of ideas, exploration and discovery. To this purpose, the rules of conduct are intended to guide behavior so that a safe and respectful environment is maintained for all library customers. The following rules apply to all individuals visiting Ramsey County Library properties.

Behaviors not allowed:

Behavior that is prohibited by law
Carrying weapons of any type
Physical behavior that is unsafe to library users or library staff or can reasonably be expected to damage library property or the property of others
Verbal abuse and harassing behaviors directed at other library users or library
Trespassing in non-public areas of the library
Consuming alcoholic beverages and using controlled substances
Soliciting on library property See solicitation policy


Children under the age of 8 are required to be accompanied by a responsible adult or older adolescent. For their safety, all children and vulnerable adults should have supervision in the library. See unattended child policy and unattended vulnerable adults policy

Smoking is not allowed in library buildings or within fifty feet of library entrances and library outdoor events.

Noise that is unreasonable in duration and volume is not allowed in the library. Cell phone ring tones should be turned off in the library and phone conversations longer than a few minutes should be conducted in lobby areas. See noise procedures

Internet users (wireless as well as library internet computers) must abide by the requirements for acceptable use outlined in the Ramsey County Library Internet access policy. Those using library internet access computers must follow the library branch limitations on time and manner of use. See Internet access policy

Bicycles must be left outside the library in bicycle racks. Using skateboards or other wheeled devices is not allowed in the library or at library entrances. Strollers and wheeled vehicles required for mobility are allowed.

Shirt and shoes are required to be worn in the library.

Animals other than service animals or animals for library programs are not allowed in the library nor may they be left unattended at library entrances. See unattended animal procedures

Please inform a staff member if you feel another's behavior or activity is unreasonably interfering with your use and enjoyment of the library.

These rules will be enforced in a fair and reasonable manner. The library staff has the right to make decisions that are in the best interest of the library whenever these rules do not specifically cover a situation. Whenever possible, staff will first educate individuals about the applicable policies before taking stronger measures to enforce those policies. If an individual continues to violate these policies, staff may order them to leave for the day. Any conduct that threatens the safety of any person or that is damaging to library property, equipment or facilities will result in immediate expulsion from the library premises. Library staff will contact local law enforcement officers for severe or illegal behavior or when an individual refuses to leave when told by staff to do so. Repeat misconduct or severe offenses (even if a single isolated event) may be cause for a temporary or permanent prohibition from using library facilities and services, arrest, or prosecution.

Staff will follow the established procedures outlined in "Banning Procedures." The Ramsey County Library Director shall be responsible for making the determination of a suspension of library privileges for longer than one day.

The Ramsey County libraries offer many programs and services that encourage children to develop a love of books, reading and learning. The staff in each of the Ramsey County Library buildings strives to create an inviting and fun environment for children.

Parents and caregivers must be aware that libraries are public buildings and it is not in the best interest of children to be left unattended. Children under the age of eight must be accompanied by an adult or a responsible older adolescent. Parents and legal guardians are responsible for the behavior of their minor children in the Library or on Library grounds whether they accompany them or not. The Ramsey County Library does not take responsibility for children using the library.

If an unattended child* comes to the attention of Library staff, staff will make a good faith attempt to contact the parent or guardian. If the parent or guardian cannot be reached, the child will be referred to the local law enforcement agency.

Library staff cannot be expected to monitor or prevent an unattended minor child from leaving the building.

* An unattended child is an unattended child of any age whose safety or well-being would be at risk if sent outside the Library building. Examples include: a child who is too young to be on his/her own, a child in an unsafe area, or a child left alone outside of the library after business hours. Although this definition may apply to older children, it applies to all children under the age of eight. Children under the age of eight must be accompanied by an adult or responsible older adolescent.

Ramsey County Library welcomes the use of the libraries by vulnerable adults.* Every reasonable attempt will be made within the limitations of our facilities and the comfort of other customers in these public buildings to accommodate the special needs of individuals or groups of attended vulnerable adults. The library staff is not trained to provide care for vulnerable adults and a responsible adult or caretaker should accompany vulnerable adults while they are using the library. This accompanying individual is responsible for the safety and behavior of the vulnerable adult in their care.

If an unattended vulnerable adult comes to the attention of library staff, staff will make a good faith attempt to contact a responsible adult or caretaker. If the responsible adult or caretaker cannot be reached, the vulnerable adult will be referred to the local law enforcement agency.

If an unattended vulnerable adult comes to the attention of library staff and he or she refuses the supervision of a caregiver or responsible adult while in the library, the individual will be held to the same rules of conduct as all library customers and will be subject to the same sanctions so long as they are using the library as an independent adult.

Library staff cannot be expected to monitor or prevent a vulnerable adult from leaving the building.

*A vulnerable adult is an individual over the age of 18 who has a physical or mental infirmity or other physical, mental, or emotional dysfunction that significantly impairs the individual's ability to provide adequately for their own care or manage their own behavior without assistance.

The Ramsey County libraries are vibrant, bustling, community gathering places with the capacity to host literacy-driven events and public meetings. The Library welcomes people of all ages engaged in a variety of activities such as group study, quiet conversations, and reading aloud to children.

While the Library staff supports the hum of a successful public library, staff will manage disruptive noise. Before applying sanctions, staff will attempt to assist the customer in managing the cause of the noise. Any sanction chosen to address disruptive noise will be appropriate to the level of disturbance and consistent with state law.

Cell phone usage in the library will be kept to a minimum. Cell phone ring tones are to be turned off or set to vibrate when customers enter the library. Customers should respect others by keeping conversations brief and as quiet as possible. Longer phone conversations should be taken to the front entry areas of the library.

Data Practices Act
Minnesota has enacted legislation addressing the privacy of library records. Relevant points of the Data Practices Act regarding library records are as follows:

Public vs. Private Data.
Section 13.40 subd. 2:
"(a) Except as provided in paragraph (b), the following data maintained by a library are private data on individuals and may not be disclosed for other than library purposes except pursuant to a court order.
1.data that link a library customer's name with materials requested or borrowed by the customer or that link a customer's name with a specific subject about which the customer have requested information or materials; or
2.data in applications for borrower cards, other than the name of the borrower.
(b) A library may release reserved materials to a family member or other person who resides with a library customer and who is picking up the material on behalf of the customer. A customer may request that reserved materials be released only to the customer."

Section 13.02, subd. 12:
"Private data on individuals' means data which is made by statute or federal law applicable to the data: (a) not public; and (b) accessible to the subject of the data.

Section 13.02, subd. 8: "'Individual' means a natural person. In the case of a minor or an individual adjudged mentally incompetent, 'individual' includes parent or guardian or an individual acting as a parent or guardian in the absence of a parent or guardian, except that the responsible authority shall withhold data from parents or guardians, upon request by the minor if responsible authority determines that withholding the data would be in the best interest of the minor." Gifts

The Library welcomes and encourages gifts of materials, money, and property. It is the policy of the Library that such gifts will be used solely for the purpose of enhancement to, not replacement for, government funding of basic library materials or services. The Library has the right to refuse any gift.

The Ramsey County Library Board of Trustees encourages potential donors to make their gifts to the Friends of the Suburban Ramsey County Libraries.

The Library Director will approve the acceptance of gifts valued up to $5,000. Gifts exceeding $5,000 in value will be brought to the Board of Trustees for appropriate action.

No donation of materials or property will be accepted unless it is made unconditionally and without restrictions or unless the Board of Trustees has accepted the donor's condition or restriction.

The Library will not accept any offers, gifts, or agreements that would result in placing a material obligation or a lien upon the Library's general budget revenues.

The Library cannot guarantee the permanence of any gift. All gifts may be used, sold, donated, or disposed of in the best interest of the Library.

Books and Other Materials
The Library will accept materials only with the stipulation from the donor that the Library may use the materials in any manner it deems appropriate. Materials may be added to the Library's collection, discarded, donated to other charitable organizations, or sold at the Library's discretion.

The Library reserves the right to assign any of its materials to any of its branch libraries at its discretion.

Conditions that limit access to materials or their use may not be imposed upon materials included in the Library's collection.
 
 
VII.A.2.
Monetary Gifts
The Library may accept gifts of cash, securities, and bequests to enhance the Library's services. When publicly traded stock and other types of securities are contributed to the Library, it will be the policy of the Library to sell the securities at the earliest opportunity, thereby converting them to cash.
 
 
VII.A.3.
Property Gifts
The Library will accept gifts of real, intellectual, or personal property including, but not limited to, furniture, equipment, computers, patents, and trademarks, that support the mission of the Library on a case-by-case basis. The Library will accept property only with the stipulation from the donor that the Library may use the property in any manner it deems appropriate.

The Library reserves the right to assign gifts of property to any of its branch libraries at its discretion.

Acknowledgment of Gifts
In accordance with tax regulations, the Library will provide a written acknowledgment of the receipt of gifts leaving the determination of a value of the donation to the donor.

As part of its ongoing mission to provide the public with the broadest possible spectrum of educational and recreational materials, the Ramsey County Library offers public access to the Internet.

Since Internet resources are, by their nature, not subject to the Library's traditional procedures for selection of materials, users may occasionally encounter material online they find false or inappropriate. The Library does not accept responsibility for any information found on the Internet including but not limited to inaccurate, outdated, or offensive information.
The area of Internet access policies in libraries was decided in the case of United States v. American Library Association, Inc., 539 U.S. 194 (2003).
 
 
VIII.A.1.
Internet filtering
In conformity with the provisions of public law 106-554 that relate to the Children's Internet Protection Act (CIPA), all Library computers and non-library computers accessing the Internet through the Library are filtered. This includes wireless access provided by the Library in all of its buildings. As provided by law, any library customer who is 17 years or older may request that filtering software be temporarily disabled on an individual basis. In response to such a request, staff will temporarily disable filtering software on any library-owned computer as it affects the individual's use without soliciting an explanation or justification, other than that required to verify the age of the requesting individual. Due to technical limitations, the Library will not disable filtering on its wireless network.

Despite efforts of staff and filtering software developers, no filtering software is infallible. Constitutionally allowed material may occasionally be blocked by our filters, and proscribed material may occasionally evade the filters. For these reasons, library users must exercise their own judgment in undertaking Internet usage. In all cases, whether filtering is or is not in place, individuals who access the Internet through the Library shall conform to legal and procedural requirements outlined in the Disclaimer and in the Requirements for Acceptable Use of the Internet listed below.
 
 
VIII.A.2.
Disclaimer
The Ramsey County Public Library expects all persons who access the Internet through its facilities to conduct themselves in accordance with state and federal law and regulations. In particular, this means that Internet users will comply with laws governing obscenity, child pornography and materials harmful to minors. Such laws include, but are not limited to, Minnesota Statutes sections 617.241, 617.245, 617.246, 617.247, and 617.291 through 617.296, as well as the provisions of Public Law 106-554 that relate to the CIPA and Neighborhood Children's Internet Protection Act (NCIPA).

The Ramsey County Library does not accept responsibility for any damage caused or incurred by persons who choose to access the Internet through the Library.
 
 
VIII.A.3.
Requirements for Acceptable Use of the Internet
The Library provides Internet access to users who understand the importance of using the Internet responsibly and who agree to respect the rights of other users. Internet users shall:
Display or access material in accordance with copyright laws and database license agreements.
Make use of library hardware and software in a responsible manner that does not deliberately disrupt or degrade the integrity of data, or compromise technical performance standards of the Library's computer system.
Refrain from activity that deliberately seeks to create a threatening or hostile environment for staff or other library users. Such activity includes, but is not limited to, the use of shared printers to reproduce offensive material from the Internet, if this action has the effect of creating a threatening or hostile environment for the reasonable man or woman.
Refrain from any online or other activity prohibited by state or federal law, including, but not limited to Minnesota Statutes sections 617.241, 617.245, 617.246, 617.247, and 617.291 through 617.296, as well as the provisions of Public Law 106-554 that relate to (CIPA) and (NCIPA).
 
 
VIII.A.4.
Limitations on Use
Individual branches may place limitations on time and manner of Internet use, in order to regulate Internet access as equitably as possible, and to respect the rights and concerns of all library users.
 
 
VIII.A.5.
Children's Use
Parents and guardians have authority over their children's internet usage. A parent may limit or prevent a child's Internet Access by requesting that the child's card be issued with the necessary restrictions. The Library recognizes that the responsibility for the guidance and regulation of a child's use of the Internet lies with the parent. The Library urges parents to work with their children to foster productive and satisfactory online experiences. As a convenience to parents, individual branches may establish certain additional guidelines governing manner and/or time of use for Internet terminals that are specially designated for use by children. Parents or guardians of a person under the age of 18 may, through formal request, prevent such a person from Internet access.
 
 
VIII.A.6.
Failure to Comply
As is the case with any policy established for the harmonious and orderly conduct of Library business, failure to comply with the regulations of this Internet Policy may result in loss of access to Library services and facilities. Appropriate legal sanctions may be used against those who willfully violate the provisions of this policy.
